In Alaska, employers (public and private) are legally permitted to review an applicant’s criminal history during pre-employment background screening. NCS reports include convictions and serious pending cases associated with the applicant.

Employers may not:

  • Inquire about or use expunged charges
  • Access sealed records
  • Consider dropped or dismissed charges or arrests not leading to convictions
  • Require disclosure of expunged incidents

Employers must inform applicants that disclosing expunged records is not required.
