California Redacts Dates of Birth

On Sept. 1, 2021, the California Supreme Court denied the request to review an existing court rule prohibiting clerks from searching for records that match a date of birth. (The same rule similarly prohibits use of driver’s license number or social security number.)

This denial means we will continue to see courts in California redacting the date of birth from both their online and public access terminals. It is also possible that  court clerks will stop providing clerk assistance to verify full dates of birth – as we have recently seen in Los Angeles County. This means criminal record checks in California will continue to become increasingly more difficult. The Professional Background Screening Association (PBSA) is already working toward potential paths to resolution, but they will take time.
