Accessing Criminal Records
In Colorado, it is legal for all private and most public employers to conduct inquiries about an applicant’s criminal history as part of the pre-employment background screening process.
Employers with at least four employees may not check a job applicant’s consumer credit report unless:
- The information is “substantially related” to the position, or
- Required by law (e.g., banks, financial institutions, or positions involving federal contracts in defense/intelligence/security/space).
All employers are also prohibited from asking about past salaries during employment verification to help stop wage discrimination.

Ban the Box Policies – Colorado
Colorado has two ban-the-box laws affecting how and when criminal history may be considered:
1. Employers in Certain Public Sector Roles
These employers must:
- Not state in job ads that individuals with records may not apply
- Wait until the applicant is a finalist or offered a conditional offer before checking criminal history
- Avoid disqualifying candidates based on arrests or non-convictions
- Only disqualify based on convictions after reviewing the offense, relevance to the role, time elapsed, and rehabilitation evidence
2. Colorado Chance to Compete Act (All Employers)
All Colorado employers must not:
- Say in a job ad or application that individuals with criminal histories may not apply
- Ask about criminal history on the initial application
Exceptions: When prohibited from hiring due to legal requirements, or when participating in programs encouraging hiring those with records.
The City and County of Denver also have additional ban-the-box laws.
