Accessing Arrest and Conviction Records

In Georgia, all private and most public employers are legally allowed to inquire into an applicant’s criminal history. This includes reviewing conviction records.

Employers are not permitted to ask about or use:

  • Expunged arrest records
  • Dropped or dismissed charges
  • Non-conviction outcomes
  • Sealed records

Candidates must be informed that they are not obligated to disclose any expunged charges.

Georgia law requires that employers follow a formal notification process for adverse hiring decisions, in line with the Fair Credit Reporting Act (FCRA).
