Accessing Criminal Records
In Hawaii, it is legal for private and public employers to inquire about an applicant’s criminal history as part of the pre-employment background screening process; this includes reviewing conviction records. NCS makes reading reports easy. Our criminal background checks report convictions and serious pending cases that belong to your applicant.
Employers are prohibited from asking about or considering arrest records that have been expunged, charges that were dropped or dismissed, or charges that did not lead to conviction. Employers may not access sealed records or require disclosure of expunged convictions. Employers must notify applicants that they are under no obligation to share expunged information.
In Hawaii, criminal conviction records may be used to make employment decisions only if the conviction is relevant to job responsibilities. Even then:
- Felonies must be within the past 7 years
- Misdemeanors must be within the past 5 years
- Consideration may occur only after a conditional job offer is made
- Some positions are exempt from this rule
Credit history inquiries are also restricted and may only occur after a job offer is made. Employers may rescind the offer if credit data negatively impacts job qualifications. These restrictions do not apply to:
- Employers required by law to review credit
- Managerial or supervisory roles
- Federally insured financial institutions
