In Michigan, both private and public employers are permitted to inquire about an applicant’s criminal history during the pre-employment screening process. This includes reviewing conviction records.

  • Ask about or consider expunged arrest records
  • Access sealed records
  • Ask about charges that were dismissed, dropped, or did not result in conviction

Important: Employers must inform applicants they are not obligated to share expunged information.
