Accessing Criminal Records
Minnesota law allows both private and public employers to review criminal records during pre-employment screening, including conviction records. NCS simplifies this process by clearly reporting convictions and serious pending cases.
Employers may not:
- Ask about or consider expunged records
- Require disclosure of dropped, dismissed, or unconvicted charges
- Access sealed records
- Ask for expunged charges to be shared
Employers must clearly inform applicants that expunged records do not need to be disclosed.
Additional Public Sector Requirement:
If a public-sector employer in Minnesota rescinds a job offer based on a background check, they must provide the applicant with written notice including:
- Reason for denial
- How to file a complaint or grievance
- When the applicant can reapply
- Assurance that rehabilitation evidence will be considered
