Background Checks
NCS makes navigating Mississippi background checks easier! Whether you work in manufacturing, agriculture, forestry, logistics, or another industry, background checks are a critical part of the hiring process.
Accessing Criminal Records
In Mississippi, both private and public employers may legally review an applicant’s criminal history as part of the pre-employment screening process. NCS simplifies report interpretation, providing details on convictions and serious pending cases.
Employers cannot:
- Access sealed records
- Inquire about expunged charges
- Consider charges that were dropped or dismissed
- Require disclosure of expunged arrests or convictions
Applicants must be clearly informed they are not obligated to share information about expunged charges.
Mississippi Expungement Law
First-time misdemeanor offenders in Mississippi may petition the court for expungement. Certain first-time felony offenses may also be expunged after five years have passed following completion of sentencing. These include:
- Passing bad checks
- Simple possession of a controlled substance or paraphernalia
- False pretenses
- Larceny
- Shoplifting
- Malicious mischief
Only one expungement is allowed per person. While expunged convictions are not reported, employers are permitted to ask if the applicant has had any expunged convictions.
