Restrictions on Criminal Record Reporting

Background reports often include sensitive personal and personally identifiable information (PII). Because of this, various local, state, and federal regulations protect individuals and enforce fair hiring practices.

South Carolina

Relevant laws include:

  • S.C. Code Ann. § 37-20-170: Requires notice of the basis for denial and proof of accuracy when background data is used.
  • S.C. Code Ann. § 17-22-960: Expunged records may not be used in hiring decisions. Employers are immune from negligent hiring claims based on these.
  • S.C. Code Ann. § 63-11-70: Child welfare agencies can consider facts of a pardoned offense, but not the pardon itself.

Some municipalities (Columbia, Rock Hill, Charleston, Greenville, North Charleston, Goose Creek, Mount Pleasant, and Summerville) allow background checks only after a conditional offer of employment is made.
