Employers may not:
- Inquire about or consider expunged records
- Access sealed records
- Require disclosure of charges that were dropped, dismissed, or not resulting in a conviction
- Ask candidates to disclose expunged charges
Employers must inform candidates that disclosing expunged charges is not required.
Note: In South Dakota, Class 2 misdemeanors and petty offenses are automatically removed from public records five years after the sentence is completed—provided no further convictions occur.
